Twin Auctions operates in accordance with all applicable municipal and provincial regulations related to public auctions in Alberta. By participating in our auctions, you agree to comply with these regulations.


When you submit a bid you are entering into a binding agreement with Twin Auctions in which the following terms and conditions are applicable. By submitting a Bid Twin Auctions is inclined to believe that you have read all terms and conditions in their entirety and you as a buyer are willing to abide by them. In order to place any bids, you must be registered with a valid email address and a valid credit card must be attached to your account. These terms and conditions will be available for viewing at any time through a link on our web page. Twin Auctions has the right to amend these terms and conditions at any given time without notice.


1. FEES
a. All Lots are subject to a buyers fee: 12% with a max of $300 per lotted item up to $10,000 / 3% fee on lots over $10,000
b. Payment Options: Cash, Check, Debit, E-transfer, Wire Transfer, Credit Card (subject to 3% convenience fee).
c. Storage Fees are applicable if purchases are not removed within 7 Days. The storage rates are $5/sq. ft. (minimum $5). If arrangements are made for a delayed pick up, no fees will be applied.


2. SELLING

a. Twin Auctions /twinauctions.com will be the agent for the SELLER and will sell all attached listed items to the highest bidder by public internet online auction at the appropriate commission rate (see commission structure below) of the gross amount of the highest bid for all items sold at the internet online auction. A Carfax fee of $60 will apply to vehicles. This will be deducted from your sale proceeds or invoiced following auction. Other items requiring a lien search will incur a $10 charge.

b. The agent will conduct the auction, make all collections and finalize billing details directly connected with the auction. If for any reason any item consigned to this auction is unsold, unless agreed to relist the agent’s sole liability shall be to make the item available for seller to retrieve and the seller shall have no further claim.

c. All payments to seller less commission, lot entry fees, any other fees contained in this contract shall be made in the form of a company check or e-transfer mailed/emailed to the seller within 3 business days from when the auction gets paid.

d. Seller will furnish a complete descriptive list of the items being consigned to be sold at auction, including model numbers, serial numbers, dimensions, etc. All items must be clean and in the most functional condition practical.

e. Any misrepresentation by the seller as to description or condition of items will allow the agent to make a downward adjustment to the selling price at agent’s discretion.

f. Seller guarantees that he/she has the right to sell items in the auction, and that they are without liens or encumbrances of any kind. Agent reserves the right to refuse to sell items at any time for any reason.

g. Seller will assume all lawyer fees and court costs should any litigation be brought forth from any buyer in regards to the seller’s items and representation of those items.

h. Seller / Consignor will maintain insurance on their items, and holds Twin Auctions /twinauctions.com harmless for any damage or liability claims resulting from involvement of equipment or property at the site until seller has been paid by agent. Seller will be liable for any theft, damage, fire damage or vandalism that may occur while on auction premises or while being handled by agent.

i. Seller agrees that items herein listed will not be withheld or disposed of in any manner and that agent makes no guarantees as to selling price. Seller is expected to pick up or reassign unsold items during the scheduled auction end pick up dates / times. Late pick up will result in storage fees to be billed at $5 per day.

j. Sellers are strictly prohibited from bidding on their own items or arranging for others to bid on their behalf for the purpose of inflating the price (also known as "shill bidding"). This practice is unethical and undermines the integrity of the auction process. Twin Auctions reserves the right to cancel any sale found to be in violation of this rule, remove the seller from future auctions, and pursue legal remedies if necessary.

k. No buybacks are permitted on Unreserved Lots. Once an item is listed in an unreserved auction, it must sell to the highest bidder, regardless of price. Sellers agree that by placing items in an unreserved auction, they forfeit the right to reclaim the item or arrange for any party to repurchase it on their behalf. Any attempt to do so may result in removal from future auctions and cancellation of the transaction.

 

3. CONDITIONS
a. All descriptions are a guide only, Twin Auctions makes no guarantees as to the
condition of any given item. Please visit the auction or send someone on your
behalf to inspect the asset and satisfy yourself to its condition.
b. At Twin Auctions we do our very best to picture and describe the items in a fair
and transparent manner.
c. All items are sold as is, where is.
d. Twin Auctions is not able to honour “mistakes”.
e. No sale will be deemed null and void or refunded based on defect or inaccuracy in the
listing. All listings are considered a guide only based on information provided by the
consignor and information gathered from sources Twin Auctions trusts to be
reliable, however Twin Auctions can not guarantee their accuracy.



4. LOTS
a. Twin Auctions Reserves the right to add or delete items at any given time before and during the auction.



5. PAYMENT
a. By submitting a bid, you are agreeing to be financially responsible for any and all items
associated with your account.
b. Purchases must be paid for in full within Seven (7) Business Days.
c. Twin Auctions Accepts Cash, Check, Debit, Credit Card (3%), Etransfer & Wire
Transfer as method of payment.
d. Twin Auctions Does Not Automatically charge the credit card on file following a
sale.
e. Twin Auctions Reserves the right to process payment at any time, if felt
necessary, on the credit card given.
f. You may be asked to provide a letter of credit or payment authorization from your lender
or financial institution.



6. REMOVAL
a. All Purchases are to be removed from the auction site within the timeline given.
b. All purchases must be paid for in full prior to removal
c. Twin Auctions reserves the right to hold any lot for an extended period of time as seen fit.
d. Any and all costs associated with removal will be the sole responsibility of the buyer.
e. Buyer assumes all risk involved in the removal process. Buyers are responsible for their own dismantling / loadout of purchased items. Twin Auction Staff will assist with loading when available and will not be liable for any damage that may occur as a result.
f. In the event items are not removed within 30 days, they will be considered abandoned
and resold without notice. Storage will be calculated and funds, if any remain, will
be dispersed accordingly.


7. TAXES
a. Twin Auctions will charge taxes where applicable at the appropriate tax rate.


8. SOFT CLOSE
a. All of Twin Auctions online auctions have a soft close in effect. Also referred to as a bid extension.
i. If a lot has a bid placed within the last One (1) Minute of the close time, that lot will be extended for another Minute (45-60 seconds). This can continue for an indefinite amount of time until all bidding is ceased.


9. TECHNOLOGY
a. Twin Auctions can not guarantee the continuous operation of the web based, and mobile app bidding platform. Our servers are subject to failure or delay beyond our control. Twin Auctions will not be held liable for any such events.
b. Twin Auctions is aware that connection may be lost to the web based, mobile app bidding platform. In the event your internet/mobile connection is lost, Twin Auctions will not be held liable.



10. PRE-AUTHORIZATION
a. By Registering an account with Twin Auctions you give permission to to perform a $1.00 CAD Pre authorization on your credit card. This is NOT a transaction, it is simply a ping to validate the card. Some banks might hold this up to 5 days.



11. BIDS
a. All bids placed are binding. You can not remove or lower bids.
b. Twin Auctions is not able to honor mistakes. Please know what and how much you are bidding prior to placing a bid

13. REGISTRATION
a. Twin Auctions reserves the right to revoke any registration at any time without notice.
b. Common reasons for this, but not limited to: Failure to Pay, Failure to pick up
c. Twin Auctions reserves the right to restrict your bid limit.

14. UNRESERVED LOTS
a. Unreserved Lots are items listed for sale with no minimum bid and no reserve price. The highest bid at the close of the auction will be the winning bid, regardless of the final amount.
b. All Unreserved Lots are final sale to the highest bidder. The seller cannot withdraw the item or refuse the final bid after the auction closes.
c. Buybacks are strictly prohibited on unreserved items. Sellers agree not to bid on their own items or arrange for others to do so. Any violation may result in the cancellation of the sale and removal of the seller from future auctions.
d. Twin Auctions is not responsible for a seller's dissatisfaction with the final price achieved for unreserved lots. By choosing to list an item unreserved, the seller accepts the risk and reward of open bidding.

15. RESERVED LOTS
a. Twin Auctions may offer specific items for sale as Reserved Lots, meaning a minimum bid (reserve price) has been set by the seller and must be met before the item will be considered sold.
b. Reserved Lots will be clearly marked as such in the online auction catalog and/or item title.
c. Bids placed below the reserve price may not result in a sale. Twin Auctions is under no obligation to disclose the reserve price or to accept the highest bid if the reserve is not met.
d. In the event that a lot with a reserve receives bids but does not meet the reserve, the seller may still choose to accept the final bid. In this case, Twin Auctions will notify the highest bidder of the seller’s decision after the auction closes.
e. No bids on Reserved Lots may be retracted once placed. All bids are final and binding.
f. Auctions may contain both Reserved and Unreserved Lots. It is the bidder’s responsibility to review each item description carefully to understand its bidding conditions.
g. Twin Auctions will not be held liable for any misunderstanding regarding reserve status or minimum pricing of items.

16. BUYER DEFAULT
a. If a buyer fails to pay for their winning bids within the required timeline, Twin Auctions reserves the right to:
i. Offer the lot to the next highest bidder;
ii. Relist or retain the item at the company’s discretion;
iii. Charge any unpaid amount to the card on file;
iv. Suspend or revoke the buyer’s registration and bidding privileges.
b. Twin Auctions may pursue legal action to recover unpaid amounts, including applicable fees and costs.

17. DISPUTE RESOLUTION
a. Any disputes arising from participation in Twin Auctions shall be governed by the laws of the Province of Alberta.
b. All disputes must be resolved in the courts of Alberta, and bidders agree to submit to the jurisdiction of those courts.
c. Twin Auctions will make reasonable efforts to resolve complaints in good faith before formal legal action is pursued.

18. PRIVACY & DATA USAGE
a. Twin Auctions collects personal and business information to process registrations, execute sales, and communicate with buyers and sellers.
b. Information is stored securely and is only shared with third parties when required for payment processing, delivery coordination, legal compliance, or with your consent.
c. Twin Auctions complies with Alberta’s Personal Information Protection Act (PIPA), which governs how private sector organizations collect, use, and disclose personal information. Your information will only be used for reasonable purposes that are clearly communicated, and with your consent.
d. By registering, you consent to receive communications about your purchases and auction updates. You may unsubscribe at any time.
